PDP failed to plan for raining day – Buhari

PDP failed to plan for raining day – Buhari
President Muhammadu Buhari on Monday in Abuja said that the 16 years rule of the Peoples Democratic Party (PDP) failed to plan for Nigeria’s raining day despite high revenue from oil during the period.
He spoke at the Presidential Villa while receiving the President of the International Civil Aviation Organisation (ICAO), Dr Bernard O. Aliyu.
For the greater part of the last 16 years, he noted that Nigeria’s oil was sold above $100 per barrel.
Buhari, in a statement by the Special Adviser on Media and Publicity, Femi Adesina, however regretted that Nigeria did not have much to show for the high revenue.
He said: “In the First Republic, more enduring infrastructure was built with meagre resources. But in the past 16 years, we made a lot of money without planning for the rainy day.
“We showed a lot of indiscipline in managing our economy, and that is why we are where we are today. But this time round, we’ll do our best.” He added
He harped on the need to ensure that the potentials of Nigeria are urgently harnessed and used for the good of the country.
AHe added: “Nigeria needs to work on her potentials, so that we don’t remain permanently at the level of potentials.
“If Ethiopia is sustained largely by her airline industry, we have greater potentials here. But we must move out, engage with the rest of the world, as we need to re-establish the integrity of this country. We need to rebuild this country again.” He said
Dr Aliyu, the Nigerian-born ICAO president commended President Buhari for strides on anti- corruption, and urged Nigeria to pay more attention to development of civil aviation.
“Civil aviation is a catalyst for economic development. The level of aviation development in any country mirrors the economic development of that country,” Dr Aliyu said.
He also pledged to support the development of the aviation industry in Nigeria, urging the country to improve on training and capacity development, aviation security, aerodromes and air navigation, runways, control towers, terminal buildings, among others.

YEHH-ERUKU: EFCC fixes date for GEJ’s arrest – Read More

former president
Dr Goodluck Jonathan, Nigeria’s immediate past president
The Economic and Financial Crimes Commission (EFCC) has fixed a date to arrest former president Goodluck Jonathan.
A source within the agency told Reportsafrique.com on April 4 that the ex-president may be arrested before May 29.
The source hinged the revelation on the level of investigations carried out on Jonathan-led administration by officials of the commission, noting that he may be arrested before President Muhammadu Buhari-led administration clocks its first year in office.
According to the source, the arrest of Azibaola Robert, the managing director of Kakatar engineering and construction company two weeks ago was a clear indication that “we are inching close to making former president Jonathan our guest,” describing Robert as the closest kinsman of the former president.
The official described as careless, the recent remarks made by former president Olusegun Obasanjo, who berated the commission and described it as a “toothless bulldog.”
The EFCC chief predicted that: “unfolding events in the next few weeks will actually confirm whether the EFCC has indeed become a toothless bulldog,” adding that: “We arrested Mr. Azibaola Robert on March 23, 2016 when he came to honour our invitation. We also arrested his wife, but she has since been granted bail. The following day, we arrested Dakoru Atukpa, Executive Director of his company. As we speak, both men are in our custody and are helping with vital information needed to nail the former president.”
The official also disclosed that Robert and Atukpa were arrested in connection to the ongoing investigations into $40million oil pipeline security contract, which stemmed from the ministry of petroleum, but was paid for by the office of the detained former national security adviser, Col. Sambo Dasuki (Rtd).
The source said the anti-graft agency is currently following a lead that indicates that One-Plus Nigeria limited, a sister company to Kakatar, which secured the oil pipeline security contract, may have acted as a front for Jonathan.
“Even though One-Plus appeared to have successfully executed the contract, we are interested in details of how the company executed the job, including those who got paid from the $40 million sum. Even though we are still investigating, there is sufficient suspicion that both men used One-Plus as front of the former President. The Managing Director of One-Plus has constantly maintained that the company was incorporated well before Jonathan became Vice President, and that it wasn’t a crime to come from Otuoke,”the official said.
The official said the commission is committed to proving Obasanjo wrong by taking on some people considered to be one of the sacred cows, saying: “You know former President Obasanjo has his unique way of passing his message. Before Obasanjo even described our Commission as a toothless bulldog, several persons accused us of shielding former President Jonathan. The truth is that we are not shielding anybody. It will not be good for us to rush to court only to be disgraced, the reason we took this long to make the arrests.
“However, be assured that a very big fish will land in our net before May 29. We intend to make the arrest of this big fish a Democracy Day gift to Nigerians,” the EFCC official said.
The EFCC official who declined to mention the big fish, however, ruled out the possibility of an early arraignment for Jonathan’s kinsmen.
The official said: “We will keep them in custody for as long as possible, and for as long as they cooperate and tell us the whole truth about what they know about the transactions, and the involvement of the former president. Fortunately, we have secured a court order to keep them (Jonathan’s kinsmen) for another two weeks. If need be, we will apply for an extension. But be assured that we won’t allow this matter go the way of others. With this case, we will prove those who accuse us of being toothless bulldogs wrong.”
When Austin Ekheinde, the head of media of Kakatar company was contacted, he refused to comment. He told journalists to speak with his boss’s lawyer Gordy Uche (SAN), who later confirmed the arrest of the duo by the EFCC.
“Yes, EFCC arrested my clients Messrs Azibaola Robert and Dakoru Atukpa, MD and ED respectively of Kakatar CE and One-Plus, on March 23 and 24th respectively, when they went to honour EFCC invitation,”Uche said.
Uche said his clients were detained in connection with a $40million pipeline security contract as well as the purchase of a N650million house. He frowned that the agency has refused to arraign them before a competent court for trial.
The lawyer further disclosed that EFCC operatives conducted several searches on the offices of his clients and carted away several documents, adding that he was reliably informed that his clients were being forced to make statements to implicate Jonathan in an apparently move to satisfy certain interests.
Meanwhile, a top officials of the ruling All Progressives Congress (APC) had earlier accused the EFCC for not going after what he termed “sacred cows.” The party chieftain has also been pressurizing President Buhari to allow EFCC go after Jonathan.
President Buhari might be absorbing such pressure considering the fact that former president Jonathan in the history of African leaders, is the first incumbent president to concede defeat in a presidential election before the electoral umpire officially announced the complete results.
The single act of humility and selflessness saved several lives that may have been lost in the post-election violence that might have trailed the announcement of the winner of the poll.
That same single act has fetched Jonathan several awards and more recognition both at home and abroad.
But, Femi Adesina, presidential media aide in an interview with Vanguard, said President Muhammadu Buhari is not shielding Jonathan from prosecution, saying: “People who say that don’t know this president. He shields nobody. Anybody that needs to be asked question can be asked question.”

OMI TI EHIN WO IGBIN LENU: [VIDEO] Tope Aluko, Fayose reconcile

Former Secretary of the Peoples Democratic Party in Ekiti, Dr. Tope Aluko who was at war with his ally, the Ekiti State Governor, Ayodele Fayose has made a U-turn and reconciled with the governor.
Aluko who had confessed on live TV that he was releasing what he called secrets of how the Ekiti election was rigged because Governor Ayo Fayose did not fulfill his promise of appointing him Chief of Staff, was seen in a video on Monday, saying he no longer has any problem with Fayose.
Earlier, Aluko had described on Channel’s TV Program, Sunday Politics how Ex-President Goodluck Jonathan and Musiliu Obanikoro allegedly spent $37m to rig Fayose into office as Ekiti Governor.
However, in the new less-than-two-minute video, which was shot in Lagos on Saturday, Fayose was seen standing beside Aluko, answering questions asked by journalists.
Fayose told journalists in the video that if he leaves Aluko to the whole world, who would be there for him.
“I am his father, I am his brother, whatever the past has held for all of us, I am still his father,” Fayose said.
Asked if he has forgiven Aluko, Fayose said, “Whether you are talking of forgiveness, Aluko remains my son, my boy… whatever he has said, it is time to move forward.”
Aluko told journalists that everything was behind now.
“This is about peace, this is about misunderstanding, this is about talking together, this is about family coming in, this is about well-meaning Nigerians coming in and that’s what we have achieved,” Aluko said.

NJC queries Judge who allegedly took bribes from Rickey Tarfa

Rickey Tarfa
A Judge of the Lagos Division of the Federal High Court, Justice Muhammed Yunusa, accused by the Economic and Financial Crimes Commission (EFCC) of allegedly receiving bribes from a senior advocate of Nigeria, Rickey Tarfa, has been queried by the National Judicial Council (NJC).
In a letter with reference number NJC/F.3/FHC.49/1/421, dated March 16, 2016, signed by the Chief Justice of Nigeria and Chairman of the National Judicial Council, Justice Mahmud Mohammed, Justice Yunusa was given 14 days to submit his response to allegations of judicial abuse, compromise and misconduct leveled against him by the Civil Society Network Against Corruption (CSNAC).
The query was sent to the embattled judge which through Justice Ibrahim Auta, the Chief Judge of the Federal High Court,
“I forward herewith a petition dated 21st December, 2015 against you by Mr. Olanrewaju Suraju, Chairman, Civil Society Network Against Corruption, on the above subject matter,” Chief Justice Mohammed wrote to the embattled judge. “The petition speaks for itself. I shall be glad to have your comments within 14 days from the date of your receipt of this letter, please”.
The response of Justice Yunusa is still being awaited, insiders say.
CSNAC had in a petition dated December 15, 2015, accused the judge of consistent refusal to abide by judicial precedents, laid down by superior courts, in granting orders and injunctions against the EFCC.
According to CSNAC, the actions of Justice Yinusa were serving as “leeway for unscrupulous and corrupt individuals, who will stop at nothing to truncate their arrest, investigation and prosecution by the appropriate law enforcement agencies, to render our criminal law ineffective, as well as allowing corruption fester in the society.”
The organisation said, “The grant of the orders of mandatory and perpetual injunctions by Justice Yunusa against the EFCC is a grave departure from the established principles in the mentioned cases, as laid down by the Supreme Court and Court of Appeal which are binding on the Federal High Court, being a lower court.
“Honourable Justice Yunusa, by the grant of these orders, has stripped the Economic and Financial Crimes Commissions of its constitutional powers as a law enforcement agency, as well its powers under the enabling law, the Economic and Financial Crimes (Establishment) Act, LFN 2004, a Federal Legislation.
“It is also a gross abuse of his powers as a judicial officer”.
The organisation further listed some of the cases concerned as:
– Suit No. FHC/L/CS/1471/2015 Mr. Simon John Adonmene & 3ors v Economic and Financial Crimes Commission filed on the 21st day of September, 2015 before Honourable Justice M.N. Yunusa of the Federal High Court, Lagos Judicial Division;
– Suit No. FHC/L/CS/487/14 – FRN v. Michael Adenuga; Suit No. FHC/L/CS/1342/15 – Senator Stella Odua v. AG Federation, EFCC, ICPC and IGP
– Suit No. FHC/L/CS/1285/15 – Jyde Adelakun & Anor v. Chairman EFCC & Anor;
– Suit No. FHC/L/CS/1445/15 – Dr. Martins Oluwafemi Thomas v. EFCC;
– Suit No. FHC/L/CS/1269/15 – Honourable Shamsudeen Abogu v. EFCC & Ors;
– Suit No. FHC/L/CS/1012/15 – Hon. Teeth Dauzia Loya v. EFCC.
The EFCC had, on February 18 arraigned Mr. Tarfa before a Lagos State High Court on a two-count charge of obstruction of justice and attempting to pervert the course of justice.
‎‎According to court documents seen by PREMIUM TIMES, in one of the allegations, Mr. Tarfa made phone contacts with Justice Yunusa in a case before the judge.
The commission provided phone numbers of Mr. Tarfa, the judge, and bank documents detailing money transfer from the lawyer to Justice Yunusa.
The EFCC also stated that from its investigations,‎ Mr. Tarfa’s law firm, Rickey Tarfa & Co. with Access Bank Account with account no. 0000964760 paid N225,000 into Justice Yunusa’s bank account.
Below is CSNAC’s petition against Justice Yunusa
21st December, 2015
The Chairman,
National Judicial Council,
Supreme Court Complex,
Three Arms Zone,
Dear Sir,
HUMAN AND ENVIRONMENTAL DEVELOPMENT AGENDA (HEDA) is a registered non-governmental organization(NGO) set up for the purpose of educating the public on human rights, the rule of law, transparency, accountability and good governance amongst others. Under our launched Judicial Integrity and Access to Justice (JIAJ) programme, we have undertaking review of judgements and judicial pronouncements of Judges across the country, with a view to assisting the National Judicial Council in her historical fight against corruption in the Judiciary.
In Suit No: FHC/L/CS/1471/2015 Mr. Simon John Adonmene & 3ors v Economic and Financial Crimes Commission filed on the 21st day of September, 2015 before Honourable Justice M.N. Yunusa of the Federal High Court, Lagos Judicial Division, the Applicants sought amongst other reliefs the following:
A Declaration that the Respondent whether by itself, staff, agents, employees, servants, officers and men under its supervision, direction and/or control is not entitled to howsoever invite, interrogate, intimidate, harass, arrest, detain, arraign, restrict the movement of the 1st Applicant and other officers of the 2nd, 3rd and 4th Applicants without lawful justification.
An Order of Mandatory injunction restraining the Respondent by itself, staff, agents, employees, servants, officers and men from howsoever inviting, interrogating, detaining, harassing, intimidating, arresting, arraigning, and/or further inviting, detaining, harassing, intimidating, arresting, and/or declaring the 1st Applicant and /or any of the directors, staff, officers and agents of the 2nd, 3rd and 4th Applicants as wanted persons.
An Order of perpetual injunction restraining the Respondent, by itself, staff, agents, employees, servants, officers, and men from howsoever freezing, confiscating, depriving and/or further freezing, confiscating, depriving the 2nd, 3rd and 4th Applicants of access to, possession of and use of their assets and the funds in their account Nos 1018826127, 0020593842, 1771258695 and 1013983247 maintained with United Bank for Africa Plc., Sterling Bank Plc., Skye bank Plc. and Zenith Bank Plc. respectively.
A declaration that the Respondent and/or any of its staff, agents, employees, servants, officers, and men under its supervision, direction, and/or control is not entitled to and/or authorized by law to issue any directive(s) to any/all banks in Nigeria, in particular, United Bank for Africa Plc., Sterling Bank Plc., Skye Bank Plc., and Zenith bank Plc., to freeze the 2nd, 3rd and 4th Applicants’ account Nos 1018826127, 0020593842, 1771258695 and 1013983247 maintained with the said banks and/or howsoever continue to freeze the said accounts, without the leave of a court of competent jurisdiction.
In a ruling delivered on the 30th day of October, 2015, Justice Yunusa granted all the orders as prayed thereby granting an Order of Perpetual Injunction against an anti-graft agency, the Economic and Financial Crimes Commission (EFCC).
Justice Yunusa in similar questionable circumstances, granted arbitrary injunction to Political Exposed Persons and other accused persons against the law enforcements agency. Some of these other cases are:
Suit No. FHC/L/CS/487/14 – FRN v. Michael Adenuga
Suit No. FHC/L/CS/1342/15 – Senator Stella Odua v. AG Federation, EFCC, ICPC and IGP.
Suit No. FHC/L/CS/1285/15 – Jyde Adelakun & Anor v. Chairman EFCC & Anor.
Suit No. FHC/L/CS/1445/15 – Dr. Martins Oluwafemi Thomas v. EFCC
Suit No. FHC/L/CS/1269/15 – Honourable Shamsudeen Abogu v. EFCC & Ors.
Suit No. FHC/L/CS/1012/15 – Hon. Teeth Dauzia Loya v. EFCC
The Supreme Court has held in a plethora of cases that the grant of perpetual injunctions against law enforcement agencies is a violation of constitutional provisions. In Kalu v FRN (2014) 1 NWLR (pt. 1389) 526 Para D-H, the court held that interference with powers given to law officers by the constitution to carry out criminal investigations cannot be departed from by court injunctions. Also in Alhaji Sani Dododo v EFCC (2013) 1 NWLR (pt. 1336) 510 Para A-C, the Court of Appeal held per Nwodo JCA as follows:
“The EFCC Act and the ICPC Act are enactments towards achieving the goal of abolishing corruption. The drive to abolish corrupt practices by established enactment and statutory provisions must not be extinguished in construction of the statutes. The intendment of the legislation must be conveyed and its provisions complied too.”
Furthermore, in Chief Rasheed Ladoja v Federal Republic of Nigeria & Anor (2014) LPELR 22432 (CA), the Court of Appeal also held:
“Anti-corruption Legislation is always construed to ensure that society is adequately protected against the canker-worm of corruption with its attendant destructive effect on the body polity of society.”
The grant of the orders of mandatory and perpetual injunctions by Justice Yunusa against the EFCC is a grave departure from the established principles in the aforementioned cases, as laid down by the Supreme Court and Court of Appeal which are binding on the Federal High Court, being a lower court. Honourable Justice Yunusa, by the grant of these orders, has stripped the Economic and Financial Crimes Commissions of its constitutional powers as a law enforcement agency, as well its powers under the enabling law, the Economic and Financial Crimes (Establishment) Act, LFN 2004, a Federal Legislation. It is also a gross abuse of his powers as a judicial officer.
These decisions, based on his Lordship’s refusal to abide by judicial precedents laid down by the apex court, will undoubtedly serve as a leeway for unscrupulous and corrupt individuals, who will stop at nothing to truncate their arrest, investigation and prosecution by the appropriate law enforcement agencies, to render our criminal law ineffective, as well as allowing corruption fester in the society.
In the light of the above, CSNAC is therefore by this petition requesting that the council carries out its constitutional role by immediately summoning Honorable Justice M. N. Yunusa on this matter and thereby ensuring that sanity is restored in the exercise of powers by judicial officers.
Attached is a sworn affidavit in support of this petition. Also attached are snippets of the above listed cases for your review.
Thank you for your anticipated cooperation and prompt actions.
Yours faithfully,
Olanrewaju Suraju

PDP responsible for fuel scarcity, says Tinubu

The National Leader of the All Progressives Congress, Asiwaju Bola Tinubu, has asked Nigerians to hold the Peoples Democratic Party responsible for the ongoing fuel scarcity across the country.
Speaking to journalists in Lagos on Saturday, Tinubu said the PDP destroyed Nigeria during its 16-year rule.
The APC chieftain said the PDP refused to pursue what was necessary for the growth and development of the country.
He said, “We want to stay focused and redirect Nigeria. We want to reverse the decay of 16 years. We are hearing comments from the PDP left and right. We are saying we want to clear the mess they created. For 16 good years, the PDP destroyed the country. We should not be lamenting over petrol queues today if they had seen what was necessary and done what was necessary for this country.
“We can’t be emotional and live in self-denial.  They should have done the Awolowo Road and the Lagos/Ibadan Expressway. If they put priority on our railroad, if they put priority on electricity generation and distribution, we will not be in this mess  today.”
Tinubu also debunked the speculation in some quarters that Nigerians were dissatisfied with the President Muhammadu Buhari-led APC government.
He said, “Nigerians are not impatient with the APC government; they just want to see the direction of the economic policy and want to be certain of the future. They want to be assured that we will not continue the leaderless, directionless and hopelessness of the past 16 years.
“The fact is that Nigerians do not want the importation of toothpicks to continue, we can make toothpicks out of our bamboo trees. Nigeria does not want to import rice or plastic. Nigeria does not want to continue in the direction of the past 16 years. What did they leave behind in our account? Why should certain things that we bring into this country become our priority? Why do we have to import those things that we can produce? The country needs surgical operation in the hands of a very honest Nigeria.”

British man jailed for keeping wife as slave

London – A British man who treated his Pakistani wife as a slave has been sentenced to two years in prison. “Following what is believed to be the first conviction in the UK for domestic servitude involving a husband and wife. “This is a ground-breaking case which demonstrates how far we have come in tackling modern-day slavery,’’ said Crown Prosecution Service lawyer Damaris Lakin in a statement. Safraz Ahmed, 34, from London, subjected Sumara Iram to “physical and mental torture’’ after she moved to Britain in 2012 following an arranged marriage which both had agreed to. “She was treated with complete contempt by the defendant who responded to her requests for affection with physical assaults and verbal abuse,’’ Lakin said. “She was isolated from the world, allowed only very restricted contact with her family and was not allowed to leave the house unaccompanied.’’ Iram was often made to work from 5 a.m. to midnight, cooking and cleaning for her husband and members of his family. Media reports said Ahmed threw tins of cat food at his wife, sent streams of abusive text messages and once told her to jump in front of a vehicle or into a river. In one attack, Ahmed broke Iram’s nose. Six months later she attempted to take her life, according to media reports. Ahmed was sentenced to two years by Woolwich Crown Court after he admitted holding his wife in servitude. He received a concurrent eight-month sentence for assault. Last year Britain passed the Modern Slavery Act to crack down on traffickers and bring in measures to protect people feared at risk of being enslaved. The Home Office (interior ministry) estimates that up to 13,000 people are victims of slavery in Britain, forced to work in factories and farms, sold for sex in brothels or kept in servitude behind closed doors.
